This new edition of the classic Principles of Injunctions restates the law and principles of injunctions in the light of the new constitutional order brought by major law reforms after the publication of the first edition of this work.
This edition notes the changes made in the law of injunctions in line with the new Constitutions in East Africa. For example, the Government Proceedings Act, forbidding the granting of injunctions against the Government of its officers, has been re-interpreted in line with the Constitution.
New orders which the author calls "cousins to injunction, such as conservatory orders are examined. So are new concepts, such as "interdicts" introduced by statute, noted.
In this edition the reader is cautioned that in the field of temporary injunctions, although the courts repeatedly say that the principles are well-settled, there still remains some considerable controversy and contradiction in the practice.
The ever-growing expansion of the use of injunctions in many fields is demonstrated in chapter 8. Banks and other financiers lending money on security and borrowers on charges and mortgages are leading users of injunctions.
