Diary of a Legal Practitioner – Constitutional Law (Volume I)

Law
KShs2,850.00

Diary of a Legal Practitioner – Constitutional Law (Volume I) presents constitutional law as more than legal theory — it is portrayed as a living reality that touches ordinary citizens in moments of crisis, justice, governance, and the exercise of public power. Grounded in Kenyan jurisprudence, the book explores how constitutional principles shape real lives in police stations, hospitals, courtrooms, and communities across the country. Drawing from decades of legal practice and constitutional litigation, the author brings to life the human stories behind fundamental rights, administrative justice, judicial independence, and the rule of law. Through narrative legal storytelling and analysis of decided cases, the book demonstrates that constitutional law exists to protect dignity, accountability, and fairness in society. Family Law Digest On Matrimonial Property by Katarina Juma and Charles Kanjama

Books
KShs1,566.00
Katarina Juma teams up with Charles Kanjama to critique the inconsistency of our courts’ decisions as regards the division of matrimonial property in Family Law Digest on Matrimonial Property. With many marriages coming apart at the seams as can be seen these days in the cacophony of cable news and social media, the book has been written to guide the parties involved on the one hand to guard against or prevent disputes and on the other, once the disputes have arisen, to guide parties to walk through them with less friction. The digest reviews the decisions of Kenyan courts when faced with the question of the determination of inter-spousal property rights. Laws on Marriages in East Africa have been scrutinized and where necessary critiqued.

Constitution-making is a major event in the life of a country, with constitutions often acting as a catalyst for social and political transformation. But what determines the visions, aspirations and compromises that go into a written constitution? In this unique volume, constitution makers from countries around the world come together to offer their insights. Using a collection of case studies from countries with recently written constitutions, Constitution Makers on Constitution Making provides a common framework to explain how constitutions are created. Scholars and practitioners very close to the process illuminate critical insights into how participants see constitutional options, how deadlocks are broken, and how changes are achieved. This vital volume also draws lessons concerning the role of courts in policing the process, on international involvement, and on public participation.

The Black Bar By Paul Mwangi

Books
KShs700.00 KShs500.00
THE RULE OF LAW WITHERS IN AN UNHEALTHY LEGAL PROFESSION Lawyers have always been recognized as the protectors of the Rule of Law. Indeed, when Shakespeare wrote in Henry V1 “The first thing we do, let’s kill all the lawyers”, it was a testimony to the fact that where lawyers honestly discharge their duty to society, they guard against lawlessness and become the single most principal assurance of the “Rule of Law”. Safeguarding the Rule of Law is one of the areas where Kenya has performed badly, giving way to impunity and utter chaos and left the weak and the poor absolutely at the mercy of the rich and the powerful. “The Black Bar” looks at this history and exposes how lawyers in Kenya have in history been accessories to the derogation of the rule of law.

The Unity of the Constitution and the Common Law: Lesson from Kenya’s Experience in Comparative Context by Jackton Ojwang

Books
KShs4,500.00 KShs4,000.00
The documentary Constitution is today in vogue as the formal normative scheme of governance, in nearly all countries. Kenya’s Constitution of 2010 is an example in this regard. Such Constitutions embody precision as well as imprecision. It falls to the Courts to undertake interpretation, and to pronounce the binding state of the law; but in the very nature of things, the outcome defies prediction. This book has drawn from the evolved principles and yardsticks of the prevalent common law, to present the pragmatic scheme that, today, guides the role of the Courts in relation to the functioning of the formal, written Constitution.

Cases and Statutes on Evidence in Sierra Leone by Joseph Amadu

𝐂𝐚𝐬𝐞𝐬 𝐚𝐧𝐝 𝐒𝐭𝐚𝐭𝐮𝐭𝐞𝐬 𝐨𝐧 𝐄𝐯𝐢𝐝𝐞𝐧𝐜𝐞 𝐢𝐧 𝐒𝐢𝐞𝐫𝐫𝐚 𝐋𝐞𝐨𝐧𝐞 is a sourcebook on the Law of Evidence in which the major decisions of the Sierra Leone Courts on the subject and local statutory enactments are collected in one secondary source. The cases presented in this compendium comprehensively discuss the legal issues that they deal with. The cases' narrative is limited to the material facts of the cases and the reasoning of the Court on the principles of law under discussion. Unnecessary prolixity is avoided. The inclusion of notes furnishes further analysis of the reported cases and cases from other jurisdictions to assist the reader in comprehending the subject.

A Court of Specialists: Judicial Behavior on the UK Supreme Court

Books, Law
KShs12,000.00 KShs9,999.00
Brief Summary This book offers the first quantitative study of decision-making on the UK Supreme Court. Covering the court's first ten years, it examines all stages of the court's decision-making process -- from the permission to appeal stage to the decision on the final outcome. The analysis of these distinct stages shows that legal factors matter. The most important predictor of whether an appellant will succeed in the Supreme Court is whether they've been able to convince judges in lower courts. The most important predictor of whether a case will be heard *at all* is whether it has been written up in multiple weekly law reports. But ""legal factors mattering"" doesn't mean that judges on the court are simply identical expressions of the law. The nature of the UK's court system means that judges arrive on the court as specialists in one or more areas of law (such as commercial law, or family law), or even systems of law (the court's Scottish and Northern Irish judges). These specialisms markedly affect behaviour on the court. Specialists in an area of law are more likely to hear cases in that area, and are more likely to write the lead opinion in that area. Non-specialists are less likely to disagree with specialists, and so disagreement is more likely to emerge when multiple specialists end up on the panel. Although political divisions between the justices do exist, these differences are much less marked than the divisions between experts in different areas of the law. The best way of understanding the UK Supreme Court is therefore to see it as a court of specialists. ""--

Doings, Non-Doings and Mis-Doings by Kenya Chief Justices 1963-1998 by Justice Abdul Majid Cockar, EGH

Books, International Bestsellers
KShs3,500.00 KShs3,000.00
The Doings, Non-Doings and Mis-Doings by Kenya Chief Justices 1963-1998 is the very first authoritative account by an 'insider' of the political and professional dynamics at play in the administration of justice, and among those who dispense it, in independent Kenya. Legal experts have commented on Kenya's Chief Justices but (Rtd.) Chief Justice Abdul Majid Cockar is the very first Chief Justice to put pen to paper to give us a very personal account of the everyday goings-on which impinged on his career in the Kenya Judiciary from 1961 to 1998. The timing of the publication is a godsend given the astronomical expectations Kenyans have placed on judicial reforms, expectations which in my view, must be managed. Dr. Willy Mutunga, D.
