Diary of a Legal Practitioner – Criminal Law offers a practical and insightful look into criminal law as experienced within Kenyan courtrooms. Drawing from decades of legal practice, the book presents narrative case studies inspired by decisions of the High Court and Court of Appeal, showing how justice is shaped through due process, judicial independence, fairness, and constitutional principles.
The book explores key issues in criminal practice, including unlawful searches, defective charges, evidentiary gaps, state power, individual liberty, and judicial discretion. Rather than focusing only on legal theory, it highlights the realities behind criminal proceedings and explains why courts sometimes acquit accused persons or halt proceedings despite public expectation.
Written for advocates, judicial officers, law students, policymakers, and general readers, the book transforms complex criminal cases into accessible and engaging narratives while preserving legal accuracy and analytical depth. It emphasizes that the strength of the justice system lies not only in outcomes, but in fairness, legality, and respect for the rule of law.

Katarina Juma teams up with Charles Kanjama to critique the inconsistency of our courts’ decisions as regards the division of matrimonial property in Family Law Digest on Matrimonial Property. With many marriages coming apart at the seams as can be seen these days in the cacophony of cable news and social media, the book has been written to guide the parties involved on the one hand to guard against or prevent disputes and on the other, once the disputes have arisen, to guide parties to walk through them with less friction. The digest reviews the decisions of Kenyan courts when faced with the question of the determination of inter-spousal property rights. Laws on Marriages in East Africa have been scrutinized and where necessary critiqued.

Beacons of Judiciary Transformation by Dr Willy Mutunga

Books
KShs3,000.00 KShs2,500.00
This remarkable book contains over 60 speeches, seven judicial opinions, and three academic articles of Chief Justice Willy Mutunga written during his tenure as Chief Justice and President of the Supreme Court of Kenya from 2011 to 2016. Edited by Prof. Sylvia Kangara, Duncan Okello and Kwamchetsi Makokha, the book is a tour de force of Chief Justice Willy Mutunga’s remarkable career as the first Chief Justice under the 2010 Constitution and his efforts to transform the Judiciary, but also his role as an unrivalled leader of civil society movements in Kenya, thinker, academic, reformist and much more. The speeches, judicial opinions and academic articles are divided along the themes that resonate across Chief Justice Mutunga’s career: People, Participation and the Law; Gender Justice; the Legal Profession; Dialogue with Judges, Magistrates, Kadhis and Staff; Judicial Accountability; Jurisprudence; Elections; Expanding the Footprint of Justice; Inter-Governmental Relations; the Elite and the Academy; Nationhood; Youth Culture and the Arts; International Judicial Diplomacy; and of course Beacons for the Future. It is those Beacons for the future from which the title of this book is derived. This book therefore reflects Chief Justice Willy Mutunga’s commitment to what he calls the beacons of the 2010 Constitution. His own tenure as Chief Justice exemplified those beacons of alternative political leadership including incorruptibility, integrity, equitable distribution of resources among all people in the county, particularly minorities, and promotion of the sovereignty of the people through deep and committed public participation. Anyone who wants to understand why Kenya’s 2010 Constitution was so overwhelmingly ratified by the people of Kenya, how to interpret and understand it as well as what it means across a whole range of domains will find this book absolutely indispensable.

A Court of Specialists: Judicial Behavior on the UK Supreme Court

Books, Law
KShs12,000.00 KShs9,999.00
Brief Summary This book offers the first quantitative study of decision-making on the UK Supreme Court. Covering the court's first ten years, it examines all stages of the court's decision-making process -- from the permission to appeal stage to the decision on the final outcome. The analysis of these distinct stages shows that legal factors matter. The most important predictor of whether an appellant will succeed in the Supreme Court is whether they've been able to convince judges in lower courts. The most important predictor of whether a case will be heard *at all* is whether it has been written up in multiple weekly law reports. But ""legal factors mattering"" doesn't mean that judges on the court are simply identical expressions of the law. The nature of the UK's court system means that judges arrive on the court as specialists in one or more areas of law (such as commercial law, or family law), or even systems of law (the court's Scottish and Northern Irish judges). These specialisms markedly affect behaviour on the court. Specialists in an area of law are more likely to hear cases in that area, and are more likely to write the lead opinion in that area. Non-specialists are less likely to disagree with specialists, and so disagreement is more likely to emerge when multiple specialists end up on the panel. Although political divisions between the justices do exist, these differences are much less marked than the divisions between experts in different areas of the law. The best way of understanding the UK Supreme Court is therefore to see it as a court of specialists. ""--

As the world faces a plethora of turmoil from conflicts, civil war, and other calamities, causing people to flee for their lives, the homeless and vulnerable persons from Syria, Libya, Palestine and many sub-Saharan African countries seek a haven for their survival. Migrant minors separated from their immediate family members during these perilous journeys are susceptible to danger, are at risk of child trafficking, and are faced with immigration restrictions at the border of every country they run into. Thus, Italy’s new legislation, The Zampa Law for ‘Provision of Protection Measures’, is a boon to the children fleeing for their lives without being accompanied by any family or guardian into Italy. The Black Bar By Paul Mwangi

Books
KShs700.00 KShs500.00
THE RULE OF LAW WITHERS IN AN UNHEALTHY LEGAL PROFESSION Lawyers have always been recognized as the protectors of the Rule of Law. Indeed, when Shakespeare wrote in Henry V1 “The first thing we do, let’s kill all the lawyers”, it was a testimony to the fact that where lawyers honestly discharge their duty to society, they guard against lawlessness and become the single most principal assurance of the “Rule of Law”. Safeguarding the Rule of Law is one of the areas where Kenya has performed badly, giving way to impunity and utter chaos and left the weak and the poor absolutely at the mercy of the rich and the powerful. “The Black Bar” looks at this history and exposes how lawyers in Kenya have in history been accessories to the derogation of the rule of law.
